Law360 (August 20, 2021, 5:51 PM EDT) — An ExxonMobil Corp. policy to restrict retirement benefits to U.S.-based retirees doesn’t discriminate against retirees who live in foreign countries, a Texas federal judge ruled Friday, saying a trio of retirees failed to show the company promised a continual right to health benefits regardless of residence.
U.S. District Judge Lee H. Rosenthal turned away a challenge from three Thailand-based retirees to ExxonMobil’s restriction of retirement benefits. The company in 2020 notified retirees they would need to have a physical U.S. street address and be enrolled in Medicare to continue to be eligible for retirement plan benefits after Dec. 31, 2021.
